Welcome to the TappiPay website and payment platform.TappiPay (Pty) Ltd (“TappiPay”, “we”, “our”, or “us”) is a private company incorporated in accordance with the laws of the Republic of South Africa. TappiPay provides third-party digital payment processing technology that enable merchants to receive electronic payments from customers using approved payment rails including QR-based payments and real-time payment systems.By accessing or using this website or our payment services, you agree to be bound by these Terms and Conditions.
2. Definitions
For purposes of these Terms:“TappiPay” means TappiPay (Pty) Ltd.“Merchant” means a business that has entered into a merchant agreement with TappiPay to accept payments through the platform.“Customer” means a person making a payment to a Merchant.“Payment Platform” means the TappiPay technology used to process and route electronic payments.“Payment Rails” means the regulated payment infrastructure used to process payments including bank clearing systems.
3. Nature of the Service
TappiPay provides payment processing and settlement services between Customers and Merchants.TappiPay:facilitates the transmission of payment instructionsprocesses payments through regulated banking infrastructuresettles funds to Merchants after receipt of cleared fundsTappiPay does not:act as a banktake deposits from the publicprovide credit or lending servicesAll payments are processed through regulated South African banking partners.
4. Merchant Responsibility
Merchants using the TappiPay platform agree to:comply with all applicable laws and regulationsprovide accurate business and identification informationmaintain appropriate customer protection practicesensure goods or services sold are lawfulhonour refunds and consumer rights where applicableTappiPay reserves the right to suspend or terminate merchant access where regulatory or risk concerns arise.
5. Customer Payments
Customers making payments via TappiPay:authorise their bank to process the payment instructionconfirm that they are authorised to use the payment accountacknowledge that payment authorisation is irrevocable once submittedAny disputes regarding goods or services must be resolved directly with the Merchant.
6. Payment Settlement
Funds collected on behalf of Merchants are held in a designated safeguarding account with a licensed South African bank and are settled to Merchants in accordance with the Merchant Agreement.Settlement times may vary depending on:payment rail processingfraud monitoringbanking clearing processesTappiPay may delay settlement where required for fraud prevention, regulatory compliance or risk management.
7. Compliance and Regulatory Requirements
TappiPay operates in accordance with applicable South African regulatory frameworks including:anti-money laundering obligations under the Financial Intelligence Centre Actpayment system requirements under the National Payment System Actpersonal data protection under the Protection of Personal Information ActTappiPay may be required to:verify merchant identityconduct sanctions screeningmonitor transactionsreport suspicious activities to authoritiesUsers consent to these compliance measures.
8. Anti-Money Laundering and Fraud Prevention
TappiPay maintains transaction monitoring and fraud prevention controls.Transactions may be:revieweddelayeddeclinedreported to authoritieswhere required by law or where suspicious activity is detected.
9. Fees
Merchants agree to the fees set out in their Merchant Agreement or Mandate, which may include:transaction processing feessettlement feeschargeback feesTappiPay may amend fees with reasonable notice.
10. Data Protection and Privacy
TappiPay processes personal information in accordance with the Protection of Personal Information Act (POPIA).Personal information may be used for:payment processingfraud preventionregulatory compliancecustomer supportTappiPay will not sell personal information to third parties.Further information is contained in the TappiPay Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, TappiPay shall not be liable for:indirect or consequential lossloss arising from merchant disputeslosses caused by banking network interruptionsdelays caused by payment system outagesTappiPay’s liability is limited to the value of the payment transaction in dispute.
12. Suspension or Termination
TappiPay may suspend or terminate access to its services where:regulatory obligations require itfraud or suspicious activity is detectedmerchants breach these termsincorrect or misleading information is provided
13. Intellectual Property
All intellectual property related to the TappiPay platform, website and technology remains the property of TappiPay.Users may not copy, reproduce or distribute platform content without written permission.
14. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.Any disputes will be subject to the jurisdiction of South African courts.
15. Amendments
TappiPay may update these Terms and Conditions from time to time. Updated versions will be published on the website.Continued use of the platform constitutes acceptance of the updated Terms.
